Terms of Service

These Terms are a contract between you and the company that provides Joishi to you:

• If you live in Nepal: Soft Up Pvt. Ltd., Gatthaghar, Bhaktapur, Nepal.
• Everywhere else: Softup LLC, a Texas limited liability company, 1061 Agape Dr, Haslet, TX 76052-4096, United States.

"Joishi", "we" and "us" mean that company. By creating an account, making a purchase or using Joishi's website or apps, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Joishi.

• You must be at least 13 years old.
• If you are under 18 (or the age of majority where you live), your parent or guardian must agree to these Terms for you, and purchases must be made or approved by them.
• You may not use Joishi if the law of your country forbids it or if you are subject to US sanctions.

Keep your details accurate and your sign-in secure — we recommend a passkey or two-factor authentication. You are responsible for activity on your account. Tell us at [email protected] if you think someone else has used it. You can delete your account at any time in Settings.

Joishi provides Nepali (Bikram Sambat) and Gregorian calendars, date conversion, festivals, panchanga and muhurta; Vedic astrology (Jyotisha) charts, dashas, yogas, matchmaking and related calculations; horoscopes; AI-generated answers and life reports; tools for professional astrologers; gold, silver and exchange rates; and a handwritten kundali delivered by courier. Some features are free and some are paid. We may add, change or retire features; if we permanently discontinue a paid service before providing what you paid for, we will refund the part not provided.

Market rates (gold, silver, currency) come from third parties, may be delayed or wrong, and are for information only.

• AI answers and reports are generated automatically by machine-learning models. They can be inaccurate, incomplete or inconsistent, and they are not reviewed by a person before you see them.
• Use your own judgment; the limits in Section 5 apply to AI output too.
• Do not use AI features to create unlawful, harmful or deceptive content, or try to make them reveal their instructions or misbehave.
• Subject to these Terms, you may use the answers and reports generated for you for your own personal purposes.

You own what you enter into Joishi (such as notes, birth details and questions). You give us a limited licence to store and process it only to provide Joishi to you. When you add another person's details, you confirm that you are entitled to — as their parent or guardian, with their permission, or as their professional with their consent.

If you send us feedback or ideas, we may use them without obligation to you.

If you use Joishi to serve your own clients, you are responsible for your advice, for any licences your work requires, and for having your clients' permission to store their information here. For client information we act as your service provider and process it on your instructions, as described in our Privacy Policy. You may not present Joishi's output as a guarantee of any outcome.

• Prices are shown before you pay, in the currency set by the country on your account (US dollars, Indian rupees or Nepalese rupees). Taxes are added where required.
• Payments on the website are taken by our payment processors (such as Stripe and connectIPS); in the apps, digital purchases are made through the Apple App Store or Google Play and are also governed by their terms.
• AI credits have no cash value, cannot be transferred or exchanged for money, and are used as described when you buy them. Credits included with a plan renew with the plan; purchased credits do not expire while your account is open, unless the offer said otherwise.
• Coupons and promotions follow the terms shown with them and cannot be combined unless stated.
• We may change prices for the future. A change never affects a purchase already made; for subscriptions, see Section 10.

• Cancel online at any time: in Settings → Billing on the website, or in your Apple or Google subscription settings for plans bought in the apps. Cancellation stops the next renewal; you keep access until the end of the period already paid.
• We will send you a confirmation with these terms when you subscribe, a reminder at least once a year for yearly plans, and notice before any price increase takes effect. You can cancel before the increase applies.
• If a free trial is offered, we will tell you before it becomes paid, and you can cancel before then to avoid being charged.

If something you paid for does not arrive or does not work, we fix it rather than refund it:

• A life report or other paid item that fails to generate is regenerated at no charge.
• A handwritten kundali that arrives damaged, contains an error on our part, or is lost in transit is rewritten and resent at no charge (Section 12).

The only exceptions are the ones the law does not let us exclude:

• A duplicate charge, or a charge made in error, is refunded.
• If we are unable to provide what you paid for at all, we refund the amount for what was not provided.
• Purchases made through the Apple App Store or Google Play are subject to their refund policies; request those refunds from Apple or Google.
• Refund rights that the consumer law of your country gives you and that cannot be waived still apply.

Cancelling a subscription stops future renewals only (Section 10).

• The handwritten kundali is written by hand from the birth details you provide and delivered by courier, currently within Nepal only. Check the details and address carefully; the kundali is written exactly from them.
• Orders cannot be cancelled or refunded once paid (Section 11). If an address outside our delivery area gets through, or we cannot fulfil the order at all, we refund it.
• Delivery dates are estimates. Ownership and risk pass to you on delivery. Please provide a reachable phone number; a parcel returned because it could not be delivered may incur a redelivery charge.
• If the kundali arrives damaged, contains an error on our part, or is lost in transit, tell us within 14 days of delivery (or of the estimated delivery date) and we will rewrite and resend it at no charge. An error in the details you provided is not our error.

You agree not to:

• Break any law, or infringe anyone’s rights or privacy
• Enter someone’s information without the right to do so
• Access Joishi by scraping, bots or automated means except through features we provide, or copy or resell our data, calculations or content
• Probe, attack or overload our systems, or bypass security, limits or payment
• Share your account, or create accounts to abuse free offers, coupons or credits
• Upload malware or unlawful, abusive or deceptive content
• Reverse-engineer the apps except as the law expressly allows

Joishi, its software, design, text, calculations, data compilations, interpretations and trademarks belong to us or our licensors. We give you a personal, non-exclusive, non-transferable, revocable licence to use Joishi for your own purposes under these Terms. Everything else is reserved.

If you believe content on Joishi infringes your copyright, send our designated agent a notice under the US Digital Millennium Copyright Act (17 U.S.C. §512): Softup LLC, Attn: Copyright Agent, 1061 Agape Dr, Haslet, TX 76052-4096, United States, [email protected]. Include the work, the material and where it is, your contact details, a good-faith statement, a statement under penalty of perjury that you are authorized, and your signature. We remove infringing material and end the accounts of repeat infringers.

Joishi relies on third-party services (such as payment processors, sign-in providers, AI providers and couriers) whose own terms may apply. We are not responsible for third-party websites or services.

If you downloaded Joishi from Google Play, Google Play's terms also apply.

To the extent the law allows, you will defend and compensate us for claims and costs arising from your breach of these Terms, your misuse of Joishi, or information you entered about others without the right to. This does not apply to consumers where local law forbids it.

You may stop using Joishi and delete your account at any time. We may suspend or close an account that breaks these Terms, creates legal risk, or is used for fraud or abuse, and will tell you why unless the law or safety prevents it. If we close your account without cause, we will refund prepaid amounts for services not yet received. Sections that by their nature should survive — such as 5, 11, 14 and 17 to 23 — survive.

This section applies if you live in the United States.

• United States and everywhere else except as below: the laws of the State of Texas and applicable US federal law, without regard to conflict-of-law rules. Any court proceeding permitted by Section 21 will be in the state or federal courts of Texas, unless you are entitled to sue where you live.
• Nepal: the laws of Nepal and the courts of Nepal.
• EEA, UK and other places with mandatory consumer law: you keep the protection of the mandatory law of your country and may bring proceedings in your local courts.

• Changes: we may update these Terms. For material changes we will tell you in advance in the app or by email; continuing to use Joishi after they take effect means you accept them. Changes do not apply to disputes that arose before them.
• These Terms and the Privacy Policy are the whole agreement between us about Joishi.
• If a provision is unenforceable, the rest remains in effect.
• Not enforcing a right is not a waiver of it.
• You may not transfer these Terms; we may transfer them to a successor or to the other Joishi company.
• We are not liable for delays caused by events beyond our reasonable control.
• Notices to you may be sent in the app or to your account email; notices to us go to the address below.
